How to file an Arbitration Case at the BCDR-AAA

In order to submit a dispute to arbitration with the BCDR-AAA under the BCDR-AAA Arbitration rules, parties to a dispute need to have a written agreement to that effect.

Filing your case at the BCDR-AAA can be done in one of two ways:

In disputes where the parties have a valid and preexisting BCDR-AAA arbitration clause or agreement concerning their dispute; either party can commence arbitration procedures by filing their claim using a Notice of Arbitration Form.

If no pre-existing agreement to arbitrate exists, both parties can commence arbitration procedures by jointly completing a Submission to Arbitration Form and submitting it to the BCDR-AAA.

All applications and submission to arbitration must include all the necessary requirements and attachments shown in Article 2 of the BCDR-AAA Arbitration Rules. 

When filing a Notice of Arbitration form, the filing party, the claimant(s), must send one copy of the above to each of the respondent, and four copies should be sent to the BCDR-AAA including the relevant filing fee. The Filing party(s) must also include the appropriate filing fee with their Notice of Arbitration before their application is accepted. When filing a Submission to Arbitration form, the parties must jointly complete and sign four copies of the form and include all the relevant attachments. Each party is to retain one copy of the Submission to Arbitration form, with two to be sent to the BCDR-AAA along with the relevant filing fee.
