Model Arbitration Clause

Inclusion of a dispute resolution clause within commercial contracts can avoid costly and time-consuming disputes further down the line. Below is the BCDR-AAA Model Arbitration Clause and the Model Arbitration Agreement:

Model Arbitration Clause

“Any dispute, controversy or claim arising out of or relating to this contract in any way whatsoever, or the breach, voidance, termination or invalidation thereof, shall be finally determined by arbitration administered by the Bahrain Chamber for Dispute Resolution (BCDR-AAA) in accordance with its Arbitration Rules.”






Model Arbitration Agreement (for existing disputes)

If a dispute has arisen, but there is no prior agreement between the parties to refer this dispute to arbitration, or if the parties are desirous to amend a dispute resolution clause to provide for (BCDR-AAA) arbitration, the following clause is suggested:

“The parties hereby agree to finally settle their dispute concerning (please insert accurate description of the dispute’s subject matter), by arbitration administered by the Bahrain Chamber for Dispute Resolution (BCDR-AAA) in accordance with its Arbitration Rules.”
